The latest on the FISA/telecom amnesty fiasco is that Majority Leader Hoyer is moving the bill, almost certainly this week.  Emptywheel reports at FDL that the vote will come tonight (Thursday) or tomorrow, unless it's linked with the supplemental appropriation for the war, in which case it's likely to come today.

As she says, the time to act is very short.  My suggestions:

  - 3rd CD folks need to get on the phone to John Salazar pronto.
  - 1st CD folks -- Diana DeGette is chief deputy whip, right?  She needs calls, too.
  - I suspect Rep. Udall and Rep. Perlmutter will vote the right way.  Let's support them on that with phone calls from those in the 2nd and 7th CDs.
  - Donate to run ads in the districts of three key supporters of telcom amnesty:  Majority Leader Hoyer, John Barrow (GA-12), and Chris Carney (PA-10).  Read up on what Glenn Greenwald is saying about why, and how, these Reps. are being targeted.
  - House leadership decides what comes to the floor for a vote ... period.  Hoyer and Pelosi, at least, are allowing this travesty to occur.  Call 'em both.

All representatives can be reached at 202-224-3121 ... ask for the office by first and last name.

Finally, Greenwald's column today takes a look at what Obama may be doing -- or not -- about the issue.  Worth a read.  (Go Sen. Obama!  But please, while you're at it, take a stronger stand against warrantless wiretapping/telecom immunity!)

[UPDATE] Greenwald has a new post saying that there's a 'compromise' on the bill that will be taken up by the House tomorrow (Friday).  He's seen the text of the bill, and it's bad -- a note from the AG is all that's needed to require a judge to throw out a warrantless wiretapping lawsuit against a telco.  But, it's not on the floor yet.  Phone, phone, phone!

This is nothing more than Steny Hoyer and Nancy Pelosi doing the will of the telecoms.  Tell your Rep. not to play ball.  Tell Hoyer and Pelosi to pull it from the floor.

[UPDATE 2] Caroline Fredrickson of the ACLU says:

This bill allows for mass and untargeted surveillance of Americans' communications ...

I'd like to underscore the fact that when the Congress was controlled by Bill Frist and Denny Hastert, the administration tried to get a bill passed legalizing warrantless eavesdropping and telecom amnesty, but was unable. They had to wait until the Congress was controlled by Steny Hoyer, Nancy Pelosi and Harry Reid to accomplish that.

That's our leadership!

... it's also about whether the Bush administration's activities will be subject to the discovery process during pending lawsuits.  I think we oughta shine a little sunshine into what's been going on, so telecom immunity is a bad, bad idea for that reason alone.

It's also a bad idea to let huge corporations buy the law they want (telco lobbyists have been in on the drafting of the legislation from the start), and legislating new permission for any administration to spy on Americans without a warrant is wrong.

Eric,  great diary!  This issue means more to me than I can express here.  It is beyond depressing to see the bipartisan Hydra of Congresspeople who are ready to capitulate and act as complicitors in the abrogation of the Bill of Rights--our Constitutional rights.  The lack of leadership on this issue by the Colorado delegation is equally depressing.  I called the Obama campaign and the person who answered assured me that I was far from the first person calling to express my concern and urge Senator Obama to lead this fight; so, the calls may make a difference.

We won't go down without a fight!  And it is also very encouraging that Jared Polis understands and cares deeply about this issue.  Jared, this is one of many reasons why my wife and I enthusiastically support your campaign here in the Second Congressional District.

I know some of the readers and posters here have a bit more access to the Obama campaign than your average voter, and I urge them to put the pressure on the Senator as well.  I am virtually certain that some of these folks are way ahead of this call to action, and for that I thank you.

Remember that the Blue Dogs want this.  Look at the last vote and count those in favor of this thing who were not Republicans or Blue Dogs. The problem becomes one of business as usual if our candidates do not disavow this.  Where is The Change?  This can be a very good test of Obama's standing by his principles.

Two weeks ago, when I interviewed Rep. DeGette, I put the question to her.

 The final, somewhat off topic question, put to the Representative was about a major issue confronting both lobbyists and the public, on which we can expect the Vice Chair of the Commerce Committee to take a solid role: telecom immunity.

Would she support retro-active telecom immunity?

"No! What sense is there in that? We're not going to have retroactive immunity. Not if I can help it."

Where's Obama? (4.00 / 2)
Obama could stop this legislation, if it was important enough to him to do so.  As the de facto head of the Democratic Party, his decision to place a "hold" on this legislation when it comes back to the Senate would almost certainly be respected by Harry the Spineless.  I really doubt Harry would refuse to respect Obama's hold, as he did to Dodd. No one else besides Obama has the political "capital" to block the bill.

And yet, the silence from Camp Obama is approaching a deafening roar.  That is really disappointing.  I will still support Obama, but I expected better from a constitutional scholar.  I think this means one of the following must be true:

1.  Obama's previous statements in opposition to telecom (and thus BushCheney) immunity were merely lip service, meant to mollify the progressives just long enough to secure the nomination, meaning he doesn't really care about this issue;

2.  Obama lacks the political will to take on a tough fight like this one; or

3.  Obama lacks the political "capital" necessary to see this fight through.

If #3, I can understand.  But, #1 or #2 would be really disappointing.

It is at times like these that I begin to wonder about whether effectuating change would be better served by a long-term effort to develop a third party--a coalition of progressives and reasonable libertarians.

When we started this "netroots" thing, we worked to get "more and better Democrats" elected. At first, we focused on the "more" part. This year, we're focusing a bit more on the "better" part. And in 2010, we'll have enough Democrats in the House to exclusively focus on the "better" part.

"After months of negotiations, the legislation unveiled today to replace the so-called Protect America Act, which Republicans refused to extend, is not a bill I can support.  I have said since the beginning of this debate that I would oppose a bill that did not provide accountability for this administration's six years of illegal, warrantless wiretapping.  This bill would dismiss ongoing cases against the telecommunications carriers that participated in that program without allowing a judicial review of the legality of the program.  Therefore, it lacks accountability measures that I believe are crucial.  My interest is not in harming telecommunications carriers.  I would have supported indemnification by the government or substitution of the government for them in these lawsuits.  But for me, there must be accountability...."

I got a call tonight from the ACLU.  The caller thanked me for being a (small) part of their online activism.  Then she asked if I would "go to the next level" by becoming a dues-paying member of the ACLU.

"Hell yes!," I said--on one condition:  they had to agree to mail me a membership card so I could be a card-carrying member of the ACLU.  "No problem," she said.

The new bill requires annual review by Inspectors General of the government's compliance with targeting and minimization procedures, which is better than nothing, but stronger amendments aimed at limiting the targeting of U.S. citizens were specifically rejected.
