     I think Al Franken is writing jokes for his fellow Democratic Senators, and I like it.

"We have some Republicans who would automatically oppose anybody who was nominated," Leahy said. "The President could nominate Moses the Law Giver. In fact I told the President, I said you realize if you'd nominated Moses the Law Giver, somebody would raise, 'but he doesn't have a birth certificate! Where's his birth certificate!'"

The bigger news is Senate Judiciary chairman Leahy's statement that Kagan should get confirmation vote before August .

   Back on the reality based planet known as earth, there is a strong progressive case for the nomination and confirmation of Elana Kagan, and ThinkProgress.org has put together a very strong case for Elena Kagan based on her progressive stances that I advise everyone to read. For me, this is the best reason why Progressives should support Elena Kagan's nomination.

    Kagan spoke out in the clearest possible terms against an amendment offered by Senator Lindsay Graham (R-SC) which would have stripped detainees of any meaningful access to judicial process:

   "To put this most pointedly," the letter said, "were the Graham amendment to become law, a person suspected of being a member of al-Qaeda could be arrested, transferred to Guantanamo, detained indefinitely ... subjected to inhumane treatment, tried before a military commission and sentenced to death without any express authorization from Congress and without review by any independent federal court. The American form of government was established precisely to prevent this kind of unreviewable exercise of power over the lives of individuals. "

   "When dictatorships have passed" similar laws, said the deans, "our government has rightly challenged such acts as fundamentally lawless. The same standard should apply to our own government."

    But as for Republican opposition to Moses the law giver's nomination to the Supreme Court, I would figure that is an obvious one. At the very least they would object to the 9th COMMANDMENT Exodus 20:16 "Thou shalt not bear false witness against thy neighbour."

   Because without fabricating facts (i.e. LYING), what would Conservatives have to talk about all day?

   In fairness to Republicans, they'd also likely characterize Moses as a judicial activist who foisted Ten Commandments on the people.

FWIW, Moses isn't eligible for political office in the United States.
He was, of course, not a U.S. citizen, nor for that matter was he an Israel citizen (having never set foot in the promised land prior to his death and a Jewish state not yet being established there).  

Moses was an Egyptian national (although probably not an Egyptian citizen), and arguably, later in his life, a naturalized Palestinian citizen, as he may have been a resident of Gaza Strip and was the leader of the local de facto Jewish tribal government (according to Exodus anyway).

Given the fact that multiple witnesses could testify to the fact that he made war on Egypt (causing multiple deaths) or gave aid and comfort to its enemies, at a time when he was an Egyptian national, he was also probably guilty of treason and Egyptian security forces had an outstanding warrant for his arrest.  He was also guilty, under Egyptian law, of human trafficing for facilitating the illegal emmigration of large numbers of people from Egypt.

Also, FWIW, there are no constitutional requirements to serve as a SCOTUS justice.  One doesn't even have to be a citizen of the United States or admitted to the practice of law here, or be of a certain age, although one does have to be a legal resident and one must be nominated by the President of the United States and confirmed by the United States Senate.

The more interesting critique comes from the left
I have to agree with Greenwald--we know almost nothing about her.  Based on what little we do know, I think we can expect her to move the Court to the right.  Whether the rightward shift is incremental or substantial, only time will tell.  It is too bad that, contrary to her statement in 1995 that confirmation hearings were "vapid, hollow charades" in which Breyer and Ginsburg received "lovefests," she has revised her opinion (I am shocked...shocked!), and now plans to stonewall the Senate (if they even asked) on her opinions on the major issues of the day.

Here's what she said back then:

Kagan, 50, former dean of Harvard Law School, has generally avoided taking stands on controversial legal issues. But as a law professor at the University of Chicago, she voiced frustration that nominees for a life-term seat on the court were allowed to "stonewall" the senators and refuse to discuss their "broad judicial philosophy" and their "views on particular constitutional issues."
