Equal Protections Against Discrimination Fails in the House

by: Fong

Thu Apr 15, 2010 at 13:04:40 PM MST

In a disappointing loss in the fight against workplace discrimination, HB1269 which would have afforded equal protection against harassment and illegal behavior against small business employees fails on the same, tired argument from Rep Joe Rice (Littleton) who says "What I fear here is that by implementing this bill the way it is, we are taking it too far and there are a lot of small businesses that will be burdened with legal fees ... when things are just starting to turn around and they're starting to focus on the business."

Right. Because of that strong correlation between the recession and "frivolous" charges of discrimination, 80% of the jobs, according to Senator Michael Bennet, that will pull us out of the recession will come from small businesses, but we won't be able to get any real legal protection against discrimination.

I highly doubt that in a recession a creepy employer on a power trip is less likely to be a creepy employer on a power trip. We should all just start praying we aren't preyed upon.

so let me get this straight
Right now if you work for a small business and your employer sexually harasses you there isn't anything you can do about it?  I mean can you sue them like you can a big corporation?

This bill would have given the same protections and damages
to small business employees (15 or less) that larger companies have. Colorado is one of nine states that has yet to put this into law. As it is now, small business employees can only get back-pay. They can't recover attorney fees or pain and suffering which exist in part, as a repellent to the illegal behavior thus, they don't have equal protection.

But if you listen to the Republicans, we're really unfriendly to business which will save us all from ourselves.

God bless our way of life.
